Examples of potential dental negligence claims:

Dental Negligence is defined as treatment that fell below the standard of a reasonable dentist which caused you avoidable harm. There are many different types of potential dental negligence claims, below are just a few examples.

Delay in diagnosing and treating Periodontal (gum) disease. If despite attending your dentist regularly, you have gum disease and have lost teeth or are worried about losing teeth then you may have a claim for dental negligence if the disease could have been diagnosed, treated and referred to a specialist earlier.

Delay in diagnosing and treating tooth decay. If despite attending your dentist regularly you have had teeth extracted due to decay or have had to undergo root canal treatment because the decay progressed into your nerve, then we will investigate if the root canal treatment could have been avoided or if the teeth could have been saved with timely diagnosis, treatment or referral. We will investigate if your dentist failed to adequately screen for decay by taking x rays and if they failed to respond to repeat infections or abscesses.

Dental Implant claims. There are numerous complications associated with implants and if your implants have failed, we can investigate if this is due to poor assessment, diagnosis, treatment planning and/or technique. If your implant restorations have failed then we can also investigate if this is due to negligence.

Wisdom tooth extraction. Sometimes lower wisdom tooth extractions can result in nerve damage, we can investigate if any potential negligence has taken place.

Substandard root canal treatment. If your root canal treatment failed, if you had pain and infection in a tooth despite having root canal treatment and the tooth has been extracted, then we can investigate if your dentist failed to carry out the root canal treatment to the correct standard.

Dental consent claims. If you have had any teeth extracted which could have been saved and you were not told about the option to save them, like the option of root canal treatment, then you may have a claim that your teeth were extracted without your consent.

Substandard cosmetic dentistry. If you have had poorly fitted crowns, poorly fitted veneers or an ill-fitted bridge that keeps falling off, or if the poor fit has caused decay, gum disease or tooth loss, then we can investigate this for you.

By law, all dentists must be registered with the General Dental Council and must have indemnity insurance in place, this allows patients like you to make a claim against your dentist’s insurance policy for compensation.
